What Legal Paternity Establishes for Your Child

Establishing paternity does more than name a father on paper. It creates a legal foundation that shapes the child’s life in concrete ways:

• Parenting time and decision-making authority: Without established paternity, a father has no legal right to seek parenting time or weigh in on decisions about education, healthcare, or religion. Arizona law prohibits courts from considering a parent’s gender in custody determinations, meaning fathers who establish paternity have equal legal standing to pursue these rights.
• Child support: Paternity creates the legal basis for a support order, so both parents can contribute financially to the child’s upbringing.
• Inheritance and benefits: A child with established paternity can access inheritance rights, insurance coverage, military benefits, and the father’s medical history. These rights can extend even after the father’s death.
• Adoption protections: A father who hasn’t established paternity can’t legally consent to or block the adoption of his child.

Arizona law also provides that if a child has lived with the father for the greater part of the prior six months and paternity has been established, the father is presumed to have legal decision-making authority unless a court orders otherwise.

How Paternity Is Established in Arizona

Arizona offers three main pathways, and the right one depends on whether both parents are cooperating. When a couple is married at the time of birth, Arizona law presumes the husband is the father and no further action is required. For unmarried parents, the father’s name on the birth certificate alone doesn’t create legal paternity.

Voluntary Acknowledgment & Recognition of Parentage

Both parents can sign a Recognition of Parentage at the hospital when the child is born or at any point afterward. Under Arizona Revised Statutes Section 25-812, a notarized Voluntary Acknowledgment of Paternity signed by both parents can also be submitted to the court to establish paternity without litigation. These are the simplest pathways when parents are in agreement.

DNA Testing & Court Action

When paternity is disputed or one party won’t cooperate, DNA testing can confirm the biological relationship with a high degree of certainty. Under Arizona law, a result showing 95 percent or greater probability creates a legal presumption of paternity, and the Division of Child Support Services can use that result to pursue a paternity determination through the court. An attorney can also file a direct action in Arizona family court without state agency involvement. Paternity proceedings can begin during pregnancy or after birth, but to establish a duty to pay child support, the case must be filed before the child turns 18.
