Legal Decision-Making & Parenting Time in Arizona

Arizona uses the term legal decision-making for authority over major decisions involving a child, including education and health care. Parenting time refers to the schedule that determines when the child spends time with each parent.

Courts may grant sole or joint authority over these decisions. A parent without that authority remains entitled to reasonable time with the child unless the court finds that contact would endanger the child. Sole legal decision-making doesn’t permit a parent to change a court-ordered parenting time plan unilaterally.

The Best Interests of the Child Standard

Arizona courts resolve these disputes according to the child’s best interests. The court evaluates the family’s specific circumstances rather than applying a single preferred arrangement.

The court considers each parent’s past, present, and potential future relationship with the child, along with the child’s adjustment to home, school, and community. Other considerations include the wishes of a child who’s of suitable age and maturity and each parent’s willingness to support frequent, meaningful contact with the other parent. In contested matters, the court must make findings on the relevant factors and explain why its decision serves the child’s best interests.

Maricopa County Parenting Requirements & Mediation

Parents in Maricopa County domestic relations cases involving custody authority must complete the Parent Information Program class. When this requirement isn’t completed, a judge can refuse to sign case papers, deny requested relief, or find a parent in contempt.

Parents who disagree about custody authority or schedules may request pre-decree mediation through the Maricopa County Superior Court Family Department. This form of mediation addresses parenting disputes. It doesn’t resolve child support, spousal maintenance, property, or debt issues.

What to Expect During a Confidential Consultation

When you contact us, we learn about your family, goals, and urgent concerns. During the confidential consultation, we explain how Arizona family laws and Maricopa County procedures affect the issues you’re facing.

We then outline a plan that addresses immediate needs, including temporary orders when appropriate, while accounting for your long-term objectives. You gain a clearer understanding of the available options before deciding how to proceed.

Straightforward Counsel & Trial Preparation

We provide straightforward advice and never make false promises about outcomes. We explain what the law requires, what the evidence supports, and what a realistic range of results looks like. We then prepare strategically for negotiation, mediation, or trial.

The many positive reviews we have received reflect our commitment to professional, transparent representation.
